Terms of Operations

Effective Date: May 30, 2025. This document governs the legal and operational agreements between Jabez Software Llc. and users of our high-volume SMTP relays, programmatic transactional APIs, and reputation monitoring services.

1. Acceptance of Terms

By registering an account, integrating SmtpHost SMTP endpoints, or invoking SmtpHost transactional API keys, you ("Customer", "User", or "Developer") unconditionally agree to adhere to these Terms of Operations. If you are entering into this agreement on behalf of a corporate entity, you verify that you possess full legal authority to bind said entity to these operational conditions.


2. Service Scope & SLA Commitments

SmtpHost provides transaction-focused delivery tunnels. We guarantee a 99.9% service uptime level for our relay infrastructure, evaluated over monthly billing cycles. System maintenance, downstream Internet routing anomalies, or suspensions resulting from acceptable use violations are excluded from our SLA telemetry metrics.


3. Registration, Credentials & API Keys

Access to our relays requires a verified user profile. You are entirely responsible for the confidentiality of authentication keys, custom SMTP passwords, and API authorization vectors. Any email transmission originating from your profile tokens is legally treated as authorized by you. SmtpHost must be notified immediately of suspected credential compromises.


4. Acceptable Use Policy & Anti-Spam Requirements

To defend our global IP pool reputation, we enforce a strict Zero-Tolerance Anti-Spam Policy. Outbound transmissions must comply with the CAN-SPAM Act, CASL, and EU GDPR. Specifically, you agree not to utilize SmtpHost to transmit:

  • Unsolicited commercial messages (SPAM) to contacts who have not opted in.
  • Fraudulent, phished, spoofed, or malware-carrying payloads.
  • Materials promoting systemic hatred, illicit substances, or unverified financial options.

5. Delivery Thresholds & Hard Bounces

SmtpHost continuously monitors transactional performance metrics. To prevent network damage, your sender profile must not exceed a 5% hard bounce rate or a 0.1% spam complaint rate over any 24-hour cycle. Accounts exceeding these bounds are subject to automated rate throttling or immediate quarantine.


6. IP Allocations & Warmup Protocols

Dedicated IP options are assigned exclusively for high-volume enterprises. Users are required to adhere to SmtpHost's automated or recommended IP warmup guidelines. Failure to warm up assigned IP addresses, resulting in systemic spam blocklists at primary ISPs, may result in the revocation of the allocated IP address without refund.


7. Technical System Security

You agree not to exploit SmtpHost service connections to perform packet floods, brute force authentication parameters, or load-test APIs beyond the rate limits defined on your account profile. Any attempts to gain unauthorized access to our core cluster configurations will result in instant termination and immediate referral to relevant cybersecurity enforcement bodies.


8. Billing, Fees & Upgrades

Subscription fees are billed in advance on a recurring monthly cycle. Upgrades apply instantly with prorated pricing, whereas downgrades or cancellations take effect at the close of your current billing period. All fees are exclusive of applicable regional taxes. Overlimit charges (such as sending additional emails beyond your standard tier cap) are billed at the standard rate defined during plan selection.


9. Refund Policy & Terms

Given the instantaneous nature of SMTP throughput allocation and data routing operations, all payments made to Jabez Software Llc. are non-refundable. Service cancellations must be completed before your next scheduled billing date to avoid automatic renewals. Accounts suspended or shut down due to Acceptable Use Policy violations forfeit all remaining balances and pre-paid rates.


10. Account Suspension & Termination

We reserve the right to suspend or terminate service access instantly, with or without prior notification, if we determine that your transmission behaviors present an active threat to SmtpHost's server operations, IP address reputation metrics, or compliance status. You can voluntarily close your account profile at any time directly through your dashboard.


11. Intellectual Property & Proprietary Rights

All software engines, API frameworks, dashboard visuals, system layouts, patents, logos, and security telemetry models remain the exclusive intellectual property of Jabez Software Llc. SmtpHost grants you a limited, non-exclusive, non-transferable, and revocable license to interact with our APIs solely to process your application's outbound emails.


12. Disclaimer of Warranties

Except as explicitly defined in our 99.9% uptime SLA, all SmtpHost services are delivered "as is" and "as available". We provide no warranties—whether express, implied, or statutory—regarding deliverability success, compatibility with legacy frameworks, or inbox placement metrics at specific ISPs.


13. Limitation of Liability

To the maximum extent permitted by applicable law, Jabez Software Llc. shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or reputation. In no event shall our total aggregate liability exceed the total amount paid by you to SmtpHost in the three (3) months prior to the event giving rise to the claim.
